Subject: Proceedings of the Interactive Session on e-service book held on 14th December. 2010 at North Block, New Delhi.
The undersigned is directed refer to the D.O. of even number dated 2nd December, 2010 from Ms. Marnta Kundra Joint Secretary, regarding Interactive Session of Nodal Officers on e-service book on 14th December, 2010. The detailed discussion on various issues including the current status of the implementation was held. The Proceedings of the Session are enclosed. All Ministries/Departments are requested to take further necessary action.

Proceedings of the two interactive Sessions on 14th December. 2010 at 10:30 AM and 03:OO PM in Room No.72, North Block, New Delhi in connection with e-service book
The Interactive Sessions of nodal officers on e-Service Book implementation was held on 14 12.2010 at 10:30 a.m. & 3.00 p.m. in Room No.72, North Block, New Delhi under the Chairpersonship of JS(Estt.), Ms. Mamta Kundra. The officials of this Department and NIC besides the representatives from the Ministries/Departments attended the session.
2. Smt. Simmi Nakra, Director, Department of Personnel & Training, welcomed all the participants to the Interactive Sessions. The background of the e-service book project was explained to them and the benefits of the system were outlined. It was stressed that employee profiles may be generated and employee feedback may be recorded. The participants were advised to start current entries in the e-service book format along with the previous entries, which could be taken care of in a phased manner by them. This would ensure that the e-Service Books become current quickly. The Joint Secretary (Establishment), Ms. Mamta Kundra, essayed that the basic objective of the Sessions was to seek suggestions and feedback on the issues related to e-Service Book. She stressed upon the importance of service book for the employee and how the e-format would be beneficial in facilitating quicker implementation.
3. The participants were also apprised of the MIS reports generated from the system. A brief was given to the participants with regard to the requirements for the Plan Scheme and they were requested to send the information as sought in the Questionnaire and prescribed proforma immediately. Shri G. K. Gaur, Sr. Technical Director, NIC, gave a brief presentation on the responses to the questionnaire and proforma received from some Ministries. He stressed upon the fact that his sample was too small to reach to some definite conclusion. It was therefore requested that remaining Ministries/ Departments may immediately forward their responses for better appreciation of the issues.
4. During the discussion various issues were raised by the participants. The representative of Ministry of External Affairs, Shri Arun Kumar Chatterjee, highlighted the security angle of the service book data. He requested the NIC to look into this aspect to ensure that the data may not be fiddled with. He also highlighted the specific issue of frequent postings abroad in case of MEA officials and associated maintenance of their service records. It was also mentioned that the Service Books of the officials joining the ministries from outside Delhi are manual service books compared to e-Service Book here and again after completion of their tenure they would have to be provided with manual service book. It was informed that the purpose of the Plan scheme is to introduce e-Service Book throughout the Government in a phased manner and hence all employees will be covered in due course.
5. Some of the suggestions received during the session include:
The ‘Help Desk’ has to be more proactive. A ‘Call Centre’ type help desk was suggested. Details of spouse, such as working or not working, place of work, date of birth, etc., may be added in the parameters to enable the user Ministry to have firsthand knowledge of status of spouse. Name & designation of the employee should be reflected automatically on all pages once the service book is opened. Service verification page is not user friendly. Mostly the Drawing & Disbursing Officer furnishes a certificate and on the basis of it service is verified as qualifying service or otherwise. Further discussion was held on the issue of verification. NIC was requested to devise a proper system for verification of the data as there is no provision of digital signature. LTC field is not restricted to one of the members of the family but instead names of all the members furnished in the family details are reflected. There needs to be some arrangement for e-service book to be sent electronically to the Pay & Accounts division for issuing “Qualifying Service” Certificate as well as at the time of settlement of retirement benefits. The leave format in the e-service book needs to be simplified and made more users friendly. At present it is just the replica of physical service book. The balance of leave does not reflect automatically. The previous account of leave is also not reflected. It was also decided to look at the leave format in the physical service book. Information entered in any field cannot be deleted. It was clarified by NIC that information once fed cannot be deleted. Only new information can be added
6.The participants were requested to intimate change of Nodal Officer/administrative officers/officials immediately for the security and authenticity of the data. They were informed that MIS reports generated with a perspective and the access to these would be provided to JS and above level officials in the Ministry, If the need for generation of some more reports was felt, the concerned Ministry may inform DOPT. It was also stressed that any other issues or suggestions which could not be highlighted in the Session could be mailed at eservicebook@nic.in.
7. The Ministries/Departments were requested to furnish the Questionnaire and Proforma A & B, including information in respect of attached and subordinate offices, at the earliest. For updated information on e-service book, the webpage, viz., persmin.gov.in/esbl23/html is required to be seen from time to time by the Ministries/Departments.

Extension of Risk Allowance till 31.12.2010

Subject:- Extension of Risk Allowance till 31.12.2010.

The undersigned is directed to refer this Department's OM No.21012/01/2008-Estt.(AL) dated 16.6.2010 vide which payment of Risk Allowance was extended till 30.9.2010. Extension of Risk Allowance for a further period of three months beyond 30.9.2010 has been considered and it has been decided that Risk Allowance may be continued for a further period of three months upto 3 1.12.2010 or till such time Risk Insurance Scheme is implemented, whichever is earlier. All the Ministries / Departments are requested lo ensure implementation of Risk Insurance Scheme before 31.12.2010. No further extension will considered thereafter.

Subject:   Allowing vigilance functionaries on deputation to CPSEs the option to draw pay either in the scale of pay of the CPSE concerned or pay in the parent cadre plus deputation (duty) allowance thereon plus personal pay, if any - Cabinet decision - reg.



           The Government had set up a Committee (2nd Pay Revision Committee) to examine and recommend changes in the pay structure, allowances, perks and benefits of the Central Public Sector Enterprises (CPSE) employees. The recommendations of the Committee were considered by the Department of Public Enterprises (DPE) and also by the Cabinet. Based on the decision of the Cabinet, the DPE had issued an O.M. No. 2(70)/08-DPE(WC) on 26th November, 2008, proclaiming the revised pay structure in CPSEs.

2. As per para 12 read with para (iv) of Annex. -1V of the above O.M., only those Government officers who come on permanent absorption basis, will get the CPSE scales, perks and benefits. However, as per guidelines for appointment of CVOs in CPSEs etc issued by DoP&T vide their OM No. 372/8/99-AVD-III dated 18th January, 200 1, the CVOs are allowed to exercise their options to draw the pay of the post in the CPSE or their grade pay. This provision is based on the policy that the CVOs are to be posted on deputation from outside the organisation and they are not allowed to be permanently absorbed in that CPSE.

3. This issue was considered by the Cabinet in its meeting held on 5th October, 2010, which decided that the Department of Public Enterprises's O.M. No. 2(70)/08-DPE(WC) dated 26.11.2008 stand amended to the effect that -

(i) CVOs and other officers on deputation to the Vigilance Departments of CPSEs may be allowed the option of electing to draw either the pay of the post in the scale of pay of the CPSE concerned or pay in the parent cadre plus deputation (duty) allowance thereon plus personal pay, if any.

(ii) The CVOs and other oficers on deputation to the Vigilance Departments in CPSEs may also be allowed all the perks, benefits & perquisites applicable to equivalent level of officers in concerned CPSEs.

Payment of additional pension/family pension on completion of age of 80 years and above

Sub:    Implementation of Government’s decision on the recommendations of the Sixth Central Pay Commission – Revision of pension of pre-2006 pensioners/family pensioners etc

    The undersigned is directed to say that in this Department’s O.M. of even number dated 21.5.2009 and 11.8.2009 it was provided that in case the information regarding date of birth/age is not available in the PPO or the office records, certain documents , viz. PAN Card, Matriculation certificate, Passport, CGHS Card, Driving licence and Voter’s ID Card, would be accepted as proof of date of birth/age for payment of additional pension/family pension on completion of age of 80 years and above. It was also provided that the Pension Disbursing Authority/Bank will make payment of additional pension/family pension in the above manner, on provisional basis, up to a period of three months from the month in which the proof of age/date of birth is submitted by the pensioner/family pensioner. In such cases, the Pension Disbursing Authority/Bank will immediately send one copy each of the document submitted by the pensioner/family pensioner to the Pay and Account Officer/CPAO for formal authorisation of the additional pension/family pension. The Pension Disbursing Authority/Bank will make payment of additional pension/family pension beyond a period of three months only on receipt of such an authorisation from the Pay and Account Officer. These instructions were reiterated in this Department’s O.M. of even number dated 25.6.2010.

2.     It has been brought to the notice of this Department that, in many cases, final authorisation could not be communicated by Pay & Accounts Offices to the Pension Disbursing Banks even after expiry of the stipulated period of three months from the month in which the proof of age/date of birth was submitted by the pensioner/family pensioner on account of non-receipt of sanction from the Heads of Offices.

3.     Considering the hardship that is likely to be caused to the old pensioners/family pensioners due to discontinuance of additional pension by the Pension Disbursing Authority/Bank in such cases, it has been decided that where the pensioner/family pensioner has submitted any of the prescribed documents as proof of age/date of birth, etc., payment of additional pension/family pension, on provisional basis, will continue to be made till 31.12.2010 or for a period of six months from the month in which the proof of age/date of birth was submitted by the pensioner/family pensioner, whichever is later. The Heads of Offices may ensure that all formalities regarding sanction may be taken up and additional pension sanctioned within the same period. In case the pensioner/family pensioner is unable to submit any of the documents mentioned in OMs dated 21.5.2009 and 11.8.2009 but claims additional pension based on some other documentary evidence, such cases will be submitted to the administrative Ministry. If the administrative Ministry is satisfied about the claim of the pensioner/family pensioner, it will authorise additional pension/family pension accordingly. The decision of the Administrative Ministry in this regard will be final.

Subject:    MODIFIED ASSURED CAREER PROGRESSION SCHEME (MACPS) FOR THE CENTRAL GOVERNMENT CIVILIAN EMPLOYEES - CLARIFICATIONS REGARDING.



            The undersigned is directed to invite reference to the Department of Personnel and Training Office Memorandum of even number dated the 19th May, 2009 regarding the Modified Assured Career Progression Scheme (MACPS). Consequent upon introduction of the Scheme, clarifications have been sought by various Ministries / Departments about certain issues in connection with implementation of the MACPS. The doubts raised by varlous quarters have been duly examined and point-wise clarifications have accordingly been indicated in the Annexure.

2 The MACPS should strictly be Implemented in keeping wlth the Department of Personnel and Training Office Memorandum of even number dated 19/05/2009 read with the aforesaid clarifications (Annexure).

3. All Ministries / Departrnents may give wide circulation to the contents of this O.M. for general guidance and appropriate action in the matter.

S.No Point of doubt Clarification
1. 1 Whether the Pay Band would change in the hierarchy of Pay Bands & Grade Pay on grant of the benefits under MACPS? Yes. The upgradations under MACPS is to be granted in the immediate next higher grade pay in the hierarchy of recommended revised pay (band and grade pay as prescribed in the CCS, (RP) Rules, 2008.
2. Whether the benefits of MACPS would be allowed to the Government servants who have been later on inducted in the Organized Group “A” Service No. The benefits under MACPS is not applicable to Group ‘A’ officer of Organised Group ‘A’ Services, as the officer under Organized Group ‘A’ Services have already been allowed panty of two years on non-functional basis with the officers of Indian Administrative Service (IAS)
3. How will the benefits of ACP be granted if due between 01.01.2006 and 31.08.2008? The new MACPS has come into existence w.e.f. 01.09.2008. However, the pay structure has been changed w.e.f. 01.01.2006. Therefore the previous ACPS would be applicable in the new pay structure adopted w e f . 01.01.2006. Para 6.1 of Annexure-1 of MACPS is only for exercising option for coming over to the revised pay structure and not for grant of benefits under MACPS. The following illustrations would explain the position:

(A) In the case of isolated post:

Date of appointment in entry Grade in the pre-revised pay scale of Rs.4000-6000: 01.10.1982

1st ACP granted on 09.08.1999 :
Rs.4500-7000 (pre-revised)

2nd ACP due on 01 10 2006 :
Rs.5000-8000 (pre-revised)
[revised PB-2 Grade Pay of Rs.4200]


3rd financial upgradation under the MACPS would be due on 01.10 2012 (on completion of 30 years of continuous regular service) in the immediate next higher grade pay in the hierarchy of recommended revised pay band and grade pay i.e. Grade Pay of Rs.4600 in PB-2.

(B) In the case of normal promotional hierarchy:

Date of appointment in entry Grade in the pre-revised pay scale of Rs.5500-9000: 01.10.1982

1st ACP granted on 09.08.1999 :
Rs.6500-10500 (pre-revised)

2nd ACP due on 01.10.2006 (as per the existing hierarchy) :
Rs.10000-15200 (pre-revised).

Therefore, 2nd ACP would be in PB-3 with Grade Pay of Rs.6600 (in terms of hierarchy available):

3rd financial upgradation under MACPS would be due on 01.10.2012 in the immediate next higher grade pay in the hierarchy of recommended revised pay band and grade pay of Rs.7600.
4. Whether the benefits of MACPS would be granted from the date of entry grade or from the date of thew regular servlce/approved service counted under varlous service rules The benefits under MACPS would be available from the date of actual joining of the post in the entry grade.
5. In a case where a person is appointed to an ex-cadre post in higher scale on deputation followed by absorption. whether the period spent on deputatlon perlod would be counted as continuous servlce in the grade or not for the purpose of MACPS (i) Where a person is appointed on direct recruitment/deputation basis from another post in the same grade, then past regular service as well as past promotions/ACP, in the earlier post, will be counted for computing regular service for the purpose of MACPS in the new hierarchy.

(ii) However, where a person iS appointed to an ex-cadre post in higher scale initially on deputation followed by absorption, while the service rendered in the earlier post, which was in a lower scale cannot be counted, there is no objection to the period spent initially on deputation in the ex-cadre post prior to absorption being counted towards regular service for the purposes of grant of financial upgradation under MACPS, as it is in the same Pay band/grade pay of the post.
6. Whether the pay scale/grade pay of substantive post would be taken into account for appointment/selection to a higher post on deputation basis or the pay scale/grade pay carrying by a Government servant on account financial upgradation(s) under ACP/MACP Scheme The pay scale/grade pay of substantive post would only be taken into account for deciding the eligibility for appointment/selection to a higher post on deputation basis.
7. In a case where 1st/2nd~ financial upgradations are postponed on account of the employees not found fit or due to departmental proceedings, etc. whether this would have consequential effect on the 2nd/3rd financial upgradation or not. Yes. If a financial upgradation has been deferred/postponed on account of the employee not found fit or due to departmental proceedings, etc.. the 2nd/3rd financial upgradations under MACPS would have consequential effect. (Para 18 of Annexure-1 of MACPS referred).
8. In a case where the Government servant have already earned three promotions and still stagnated in one grade for more than 10 years, whether he would be entitle for any further upgradation under MACPS No. Since the Government servant has already earned three promotions, he would not be entitled for any further financial upgradation under MACPS.
9. Whether the pre-revised pay scale of Rs.2750-4400 in respect of Group ‘D’ non matriculate employees, would also be taken as merged to grade pay of Rs.1800 for the purpose of MACPS in view of merger of pre-revised pay scales of Rs.2550-3200, Rs.2610-3540, Rs.2610-4000 and Rs.2650-4000, which have been upgraded and replaced by the revised pay structure of grade pay of Rs.1800 in the pay band PB-1. Yes
10. If a Govt Servant on deputation earns upgradation under MACPS in the parent cadre, whether he would be entitled for deputation (duty) allowance on the pay and emoluments granted under the MACPS or not? No. While eligibility of an employee for appointment against ex-cadre posts in terms of the provisions of the RRs of the ex-cadre post will continue to be determined with reference to the post/pay scale of the post held in the parent cadre on regular basis (and not with reference to the higher scale granted under ACPS/MACPS). such an officer, in the event of his selection, may be allowed to opt to draw the pay in the higher scale under ACP/MACP Scheme without deputation allowance during the period of deputation, if it is more beneficial than the normal entitlements under the existing general order regulating pay on appointment on deputation basis.
11. Since the pay scales of Group “D” employees have been merged and placed in the Grade Pay of Rs.1800, whether they are entitled for grant of increment @ 3% during pay fixation at every stage. Yes. On the analogy of point 22 of Annexure-1 of MACPS, the pay of such Group “D” employees who have been placed in the Grade Pay of Rs.1800 w.e.f. 01.01.2006 shall be fixed successively in the next three immediate higher grade pays in the hierarchy of revised paybands and grade pays allowing the benefit of 3% pay fixation at every stage.

Reservation in promotion – Treatment of SC/ST candidates promoted on their own merit

Subject: Reservation in promotion – Treatment of SC/ST candidates promoted on their own merit.

The undersigned is directed to refer to this Department’s O.M.No.36028/17/2001-Estt(Res.) dated 11th July, 2002 which clarified that SC/ST candidates appointed by promotion on their own merit and not owing to reservation or relaxation of qualifications will be adjusted against un-reserved points of the reservation roster and not against reserved points. It was subsequently clarified by this Department’s O.M. No.36028/17/2001- Estt. (Res.) dated 31.1.2005 that the above referred O.M. took effect from 11.7.2002 and that concept of own merit did not apply to the promotions made by non-selection method.

2. Central Administration Tribunal, Madras Bench in O.A. No.900/2005 [S. Kalugasalamoorthy v/s. Union of India & Others] has set aside the O.M.No.36028/17/2001-Estt. (Res.) dated 31.1.2005 and held that when a person is selected on the basis of his own seniority. the scope of considering and counting him against quota reserved for SCs does not arise. The High Court of judicature at Madras in the matter of UOI v/s.S. Kalugasalamoorthy [ WP No.15926/2007 ] has upheld the decision of the Central Administrative Tribunal.

3. The matter has been examined in the light of the above referred judgments and it has been decided to withdraw O.M. No. 36028/17/2001- Estt. (Res.) dated 31.1.2005 referred to above. It is clarified that SC/ST candidates appointed by promotion on their own merit and seniority and not owing to reservation or relaxation of qualifications will be adjusted against unreserved points of reservation roster. irrespective of the fact whether the promotion is made by selection method or non-selection method. These orders will take effect from 2.7.1997. the date on which post based reservation was introduced.

4. These instructions may be brought to the notice of all concerned.

Extension of Modified Assured Career Progression Scheme(MACP) to Staff Car Drivers of Central Government

Sub: Extension of Modified Assured Career Progression Scheme to the Staff Car Drivers of Central Government.

The undersigned is directed to refer to this Department's O.M. No.35034/3/2008-Estt. (D) the 19th May,2009 regarding introduction of Modified Assured Career Progression Scheme (MACPS) for the Central Government Civilian Employees and to say that para 13 of Annexure-I of the Scheme provides that Existing time-bound promotion scheme, including in-situ promotion scheme. Staff Car Driver Scheme or any other kind of promotion scheme existing for a particular category of employees in a Ministry/Department or its offices, may continue to be operational for the concerned category of employees if it is decided by the concerned administrative authorities to retain such Scheme, after necessary consultations or they may switch over to the MACPS. However, these Schemes shall not run concurrently with the MACPS.

2. In pursuance of the decision taken in the meeting of the Departmental Council (JCM) of Department of Personnel & Training held on 08.05.2010 in respect Agenda Item No. 57.31, it has been decided in consultation with the Department of Expenditure, the benefits of the MACPS shall also be extended to the regular Staff Car Drivers of the Central Government Ministries/Departments/Offices, as a fall back option, if they are unable to get promotion within the percentage based present system.

3. Para 13 of the Annexure-I of the MACPS accordingly stands modified to this effect. In other words, the Staff Car Driver Scheme and the MACPS shall run concurrently.

4. All Ministries/Departments may give wide circulation to this decision for general guidance and appropriate action in the matter.

Non-Functional upgradation for Officers of Organized Group 'A' Services in PB-3 and PB4

A reference is invited to this Department OM of even No. dated 24.04.09 on the above subject. The details of batch of the officers belonging to the Indian Administrative Service who have been posted at the Centre in the various grades of PB-3 and PB-4 w.e.f. 01.01.2006 was circulated in this Department OM of even No. dated 21.05.2009.

2. The matter has further been considered in this Department. As there is a slight change in the date of posting of first officer of IAS cadre in the Center after 01.01.2006 in the grades of Additional /Joint Secretary, a revised list in supersession of the list issued in OM dated 21.05.2009, giving the batch of the IAS officers who have been posted in the Centre in the various grades as well as the date of posting of the first officer belonging to the batch is annexed. Necessary action may be taken for grant of higher scale for the Officers belonging to batches of Organized Group A Services that are senior by two year or more and have not so far been promoted to that particular grade in accordance with the provisions of this Department OM of even number dated 24.4.2009.

Subject : Grant of Dearness Relief to Central Government pensioners who are in receipt of provisional pension or pension in the pre-revised scale of 5th CPC w.e.f. 1.1.2010.

      In continuation to this Department’s OM No. 42/12/2009-P&PW(G) dated 17th November, 2009 sanctioning the Dearness Relief to those Central Government pensioners who are in receipt of provisional pension or pension in the pre-revised scales of 5th CPC, the President is pleased to grant the Dearness Relief to these Central Government pensioners as under :

    (i)     Those who are in receipt of provisional pension or pension in the pre revised scales of 5th CPC are entitled to Dearness Relief @ 87% w.e.f 1.1.2010.

    (ii)     The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 to 31.12,1985 and are in receipt of ex-gratia @ Rs. 600/ p.m. w.e.f. 1.11.1997 under this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 are entitled to Dearness Relief @ 87% w.e.f. 1.1.2010.

2.     The following categories of CPF beneficiaries who are in receipt of ex¬gratia payment in terms of this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 are entitled to DR @ 79% w.e.f. 1.1.2010.

    (i)     The widows and dependent children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and are in receipt of Ex-gratia payment of Rs. 605/- p.m.

    (ii)     Central Government employees who had retired on CPF benefits before 8.11.1960 and are in receipt of Ex-gratia payment of Rs. 654/-, Rs. 659/-, Rs. 703/- and Rs. 965/-.

3.     In their application to the pensioners/family pensioners belonging to Indian Audit and Accounts Department, these orders issue in consultation with the C&AG.

4.    This issues with the concurrence of Ministry of Finance, Department of Expenditure vide their UO No. 377/EV/2010 dated 28.6.2010.

Subject:- Extension of Risk Allowance

    With reference to the decision of the Government to withdraw Risk Allowance w.e.f. 1.4.2009 and replace it with the Risk insurance scheme after consultation with Staff Side, a general instruction was issued by this Department vide OM No.21012/1/2008-Estt.(AL) dated 12th March, 2009 to all Ministries / Department having the component of Risk Allowance to examine the recommendation at para 4.2.68 of Sixth Central Pay Commission in the light of General Risk Insurance package formulated by General Insurers’ (Public Sector) Association of India (GIPSA) and consider as per their specific risk, needs and requirements by the respective Ministries/Departments after consultation with the Staff Side. The compliance report and the decision of the Government in this regard was required to be sent to this deptt. within two months. A subsequent reminder of even no. dated 29.10.2009 was issued by this Department to expedite the compliance report. However, compliance report has not been received by this Department till date.

2.    Keeping in view the requests from certain Ministries/Departments, it has been decided with the approval of Ministry of Finance to extend payment of Risk Allowance upto 30.9.2010 or till such time the Risk Insurance Scheme is finally introduced, whichever is earlier. All the Ministries/Deptts. are requested to ensure implementation of Risk Insurance Scheme before 30.9.2010. No further extension will be considered thereafter.

Closing of Central Government Offices including industrial establishments in connection with the elections

Subject: CLOSING of Central Government Offices in connection with elections to Lok Sabha / State Assembly / Panchayat / Municipalities / Corporation or other Local Bodies - regarding

In modification of these instructions contained in this Department's O.M.No.12/4/86-JCA dated 9th March, 1987, the prescribed for future for closing of Central Government Offices including industrial establishments in connection with the elections indicated above.

(i) The relevant organizations shall remain closed in the notified areas where general elections to Lok Sabha Or State Legislative Assembly are scheduled to be conducted.

(ii) In connection with bye-election to Lok Sabha / State Assembly, only such of the employees who are bona-fide voters in the relevant constituency should be granted special casual leave on the day of polling. Special Casual leave may also be granted to an employee who is ordinarily a rsident of a constituency and registered as a voter by employed in any Central Government Organization / Industrail Establishment located outside the constituency having a general / bye-election.

(iii) In connectin with local body elections, viz., Panchayat / Corporation / Municipality, the Government employee who are bona-fide voters and desire to excercise their franchise should be offered reasonable facility, subject to normal exigencies of service, either by coming late to office or being allowed to leave office early or a short absence on that day.

2. The employees detailed on election duty may also be permitted to remain away from their normal duties on polling day (s) as also on the days required for performing journeys which might be undertaken in order to perform such election duty

Subject:- Revision of income criteria to exclude socially advanced persons/sections (Creamy Layer) from the purview of reservation for Other Backward Classes (OBCs).

The undersigned is directed to invite attention to this Department's O.M No.36012/22/93-Estt.(SCT) dated 8th September, 1993 which inter alia provided that sons and daughters of persons having gross annual income of RS.1 lakh or above for a period of three consecutive years would fall within the creamy layer and would not be entitled to get the benefit of reservation available to the Other Backward Classes. The limit of income for determining the creamy layer status was raised to Rs. 2.5 lakh vide this Department's OM of even number dated 9.3.2004. It has now been decided to raise the income limit from Rs. 2.5 lakh to Rs. 4.5 lakh per annum for determining the creamy layer amongst the OBCs. Accordingly the following entry is hereby substituted for the existing entry against Category VI in the Schedule to the above referred O.M.Son(s) and daughter(s) of (a)Persons having gross annual income of Rs. 4.5 lakh or above or: possessing wealth above the exemption limit as prescribed in the Wealth Tax Act for period of three consecutive years. (b)Persons in Categories I, II, III and V A who are not disentitled to the benefit of reservation but have income from other sources of wealth which will bring them within the incomelwealth criteria mentioned in
a) above. Income from salaries or agricultural land shall not be clubbed.
