Child Care Leave to Central Government employees - Clarification regarding

Subject:    Child Care Leave to Central Government employees - regarding

The undersigned is directed to say that subsequent to issue of this Department OM of even number dated 07/09/2010, this Department has been receiving references from various Departments, seeking clarifications. The doubts raised are clarified as under:-

      1. Whether Earned Leave availed for any purpose can be converted into Child Care Leave? How should applications where the purpose of availing leave has been indicated as 'Urgent Work' but the applicant claims to have utilized the leave for taking care of the needs of the child, be treated?

Child Care Leave is sanctioned to women employees having minor children, for rearing or for looking after their needs like examination, sickness etc. Hence Earned Leave availed specifically for this purpose only should be converted.


2.       2.Whether all Earned Leave availed irrespective of number of days i.e. less than 15 days, and number of spells can be converted? In cases where the CCL spills over to the next year (for example 30 days CCL from 27th December), whether the Leave should be treated as one spell or two spells'?

No. As the instructions contained in the OM dated 7.9.2010 has been given retrospective effect, all the conditions specified in the OM would have to be fulfilled for conversion of the Earned Leave into Child Care Leave. In cases where the leave spills over to the next year, it may be treated as one spell against the year in which the leave commences.


3.       Whether those who have availed Child Care Leave for more than 3 spells with less than 15 days can avail further Child Care Leave for the remaining period of the current year'?

No. As per the OM of even number dated 7.9.2010, Child Care Leave may not be granted in more than 3 spells. Hence CCL may not be allowed more than 3 times irrespective of the number of days or times Child Care Leave has been availed earlier. Past cases may not be reopened.


4.       Whether LTC can be availed during Child Care Leave?

LTC cannot be availed during Child Care Leave as Child Care Leave is granted for the specific purpose of taking care of a minor child for rearing or for looking after any other needs of the child during examination, sickness etc.

      The undersigned is directed to invite reference to the Office Memorandum of even number dated 7th October 2010 on the above subject, vide empanelled hospitals under different categories the hospitals were notified and to state that as per the para (iii) of the Office Memorandum mentioned above the hospitals that are on the panel of CGHS who have did not apply in response to the fresh empanelment process initiated by the CGHS in second half of 2009 or have not been approved by CGHS under the fresh empanelment procedure can continue to treat CGHS beneficiaries at old( pre-revised ) rates till 25th October 2010. On 26th October 2010, their names will stand removed from the list of approved hospitals empanelled under CGHS, without any further notice;

      In this regard it is clarified that Primus Ortho & Spine Hospital, Chandra Gupta Marg, Chanakya Puri, New Delhi 10 021 would however, continue to be on CGHS, Delhi panel at old( pre-revised ) rates till 11th November 2010 (next date of hearing ) as per the directions of Hon’ble High Court of Delhi in WP( C ) No. 6720 of 2010 filed by ‘Delhi Hospital Society Regd., ‘ v . Union of India and Others.

Modified Assured Career Progression Scheme for the Central Government Civilian Employees - Clarification regarding

Subject :     Modified Assured Career Progression Scheme for the Central Government Civilian Employees - Clarification regarding.

     A joint committee is set up to examine the anomalies pertaining to the Modified Assured Career Progression Scheme (MACPS) vide Department of Personnel & Training O.M.No.11/1/2010-JCA dated 03-05-2010.

2.      During the joint committee meeting it was pointed out by the Staff Side that the word 'new organization' of the last line of para 24 of Annexure-I of MACPS dated 19.05.2009 was not in consonance with the spirit of the Scheme. The issue has been examined and it is clarified that in case of transfer 'including unilateral transfer on request, regular service rendered in previous organization / office shall be counted alongwith the regular service in the new organization / office for the purpose of getting financial upgradation under the MACPS. However, financial upgradation under the MACPS shall be allowed in the immediate next higher grade pay in the hierarchy of revised pay bands as given in CCS (Revised Pay) Rules, 2008. Para 24 of MACPS stands amended to this extent.

3.      The Staff Side also raised an issue on the 'benchmark' for MACP as given in para 17 of Annexure-I of MACPS dated 19.05.2009, which provides that the financial upgradation would be on non-functional basis subject to fitness, in the hierarchy of grade pay within the PB-1. Thereafter for upgradation under the MACPS, the benchmark of 'good' would be applicable till the grade pay of Rs.6600/- in PB-3. The benchmark will be 'Very Good' for financial upgradation to the promotion to the grade pay of Rs.7600 and above. It was pointed out that in some cases the promotion to the next higher grade was made on the basis of 'fitness' as the method of promotion as specified in the relevant recruitment rules, was 'non-selection'. Therefore, such cases benchmarks should not be insisted upon under the MACPS. The issue has been examined and it is clarified that where the financial upgradation under MACPS also happen to be in the promotional grade and benchmark for promotion is lower than the benchmark for granting the benefits under MACPS as mentioned in para 17 ibid, the benchmark for promotion shall apply to MACP also.

4.      All Ministries/Departments may give wide circulation to the contents of this O.M. for general guidance and appropriate action in the matter.

Safety Related Retirement Scheme in Railways - Clarification

AIRF and NFIR raised a doubt that a large number of staff working in Grade Pay of Rs.1800/- would not be eligible to avail the benefit of the above Scheme after financial upgradation under the MACPS.

2. The matter has been considered and it is clarified that for determining the eligibility for seeking retirement under the Liberalized Active Retirement Scheme for Guaranteed Employment for Safety Staff (LARSGESS), Grade Pay corresponding to the post against which the employee is working on regular basis will be taken into account. In the other words, the staff working on the post with Grade Pay of Rs.1800/- will continue to be eligible for seeking retirement under the Scheme even after getting financial upgradation in Grade Pay higher than Rs.1800/- under MACPS.

3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Subject:   Allowing vigilance functionaries on deputation to CPSEs the option to draw pay either in the scale of pay of the CPSE concerned or pay in the parent cadre plus deputation (duty) allowance thereon plus personal pay, if any - Cabinet decision - reg.



           The Government had set up a Committee (2nd Pay Revision Committee) to examine and recommend changes in the pay structure, allowances, perks and benefits of the Central Public Sector Enterprises (CPSE) employees. The recommendations of the Committee were considered by the Department of Public Enterprises (DPE) and also by the Cabinet. Based on the decision of the Cabinet, the DPE had issued an O.M. No. 2(70)/08-DPE(WC) on 26th November, 2008, proclaiming the revised pay structure in CPSEs.

2. As per para 12 read with para (iv) of Annex. -1V of the above O.M., only those Government officers who come on permanent absorption basis, will get the CPSE scales, perks and benefits. However, as per guidelines for appointment of CVOs in CPSEs etc issued by DoP&T vide their OM No. 372/8/99-AVD-III dated 18th January, 200 1, the CVOs are allowed to exercise their options to draw the pay of the post in the CPSE or their grade pay. This provision is based on the policy that the CVOs are to be posted on deputation from outside the organisation and they are not allowed to be permanently absorbed in that CPSE.

3. This issue was considered by the Cabinet in its meeting held on 5th October, 2010, which decided that the Department of Public Enterprises's O.M. No. 2(70)/08-DPE(WC) dated 26.11.2008 stand amended to the effect that -

(i) CVOs and other officers on deputation to the Vigilance Departments of CPSEs may be allowed the option of electing to draw either the pay of the post in the scale of pay of the CPSE concerned or pay in the parent cadre plus deputation (duty) allowance thereon plus personal pay, if any.

(ii) The CVOs and other oficers on deputation to the Vigilance Departments in CPSEs may also be allowed all the perks, benefits & perquisites applicable to equivalent level of officers in concerned CPSEs.

2. On re-consideration, it has now been decided that the advice given in Para 5 of Board's letter ibid may be treated as withdrawn and the payment of PLB to eligible non-gazetted Railway employees (excluding all RPF/RPSF personnel) may be made as was done during last year.

Guidelines on Air Travel on LTC - Clarifications regard to purchase of Air Tickets...

Subject: Guidelines on Air Travel on Tours / LTC.


This Department is receiving repeated references seeking clarifications with regard to purchase of Air tickets through authorized agents and relaxation for travel by Airlines other than Indian Airlines. The following guidelines may be noted for compliance:

1. On Official Tours :

(i) For travel by Airlines other than Air India because of operational or other reasons or on account of non-availability of Air India flights, individual cases for relaxation to be referred to M/o Civil Aviation, as stated in this Ministry's OM No. 19024/1/2009-E.IV dated 13.07.09.

(ii) Air Tickets may be purchased directly from Airlines (at Booking counters/Website of Airlines) or by utilizing the services of Authorized Travel Agents viz. M/s Balmer Lawrie & Company, M/s Ashok Travels & Tours.

2. LTC :

(i) Travel by Air India only.

(ii) In Economy class only, irrespective of entitlement.

(iii) LTC-80 ticket of Air India only to be purchased.

(iv) Air Tickets may be purchased directly from Airlines (at Booking counters / Website of Airlines) or by utilizing the services of Authorized Travel Agents viz. M/s Balmer Lawrie & Company, M/s Ashok Travels & Tours and IRCTC (to the extent IRCTC is authorized as per DoP&T OM No. 31011/6/2002-Estt.(A) dt. 02.12.09).

3. LTC for J&K :

(i) Relaxation to travel by Private Airlines to visit J&K while availing LTC is available to all the categories of Govt. employees, including those entitled to travel by Air [DoPT OMs No. 31011/2/2003-Esst.(A-IV) dated 18.06.10 and 05.08.10 refer].

(ii) For purchase of Air tickets, however, the procedure as given under para 2 (iv) above should be followed.

4. All Ministries/Departments of Govt. of India are requested to strictly adhere to these instructions.

Subject:       Modified Assured Career Progression Scheme for the central Government civilian employees – Clarification regarding.

      The undersigned is directed to invite reference to the Department of Personnel & Training (DOP&T)’s Office Memorandum of even number dated the 19th May, 2009 on the subject cited above. Consequent upon introduction of the Modified Assured Career Progression Scheme (MACPS), in view of para 14 of the Annexure-I of the Scheme, a number of proposals/references seeking extension of the Scheme to Central Autonomous/Statutory Bodies under various Ministries/Departments have been received by the Department of Expenditure. The Department of Expenditure has felt that keeping the large number of Central Autonomous/Statutory Bodies in view, it would be appropriate to delegate the power the approving such proposals to the administrative Ministries/Departments concerned. The Department of Expenditure has accordingly approved for extending the benefits of the MACPS to the Central Autonomous/Statutory Bodies under various Ministries/Departments subject to them satisfying the following four conditions:

      (i)       The earlier ACP Scheme was also implemented/adopted by the said Autonomous/Statutory Body.

      (ii)       The proposal to adopt MACP Scheme has been approved by the Governing Body/Board of Directors.

      (iii)       The Administrative Ministry/Financial Adviser of the Ministry has concurred with the proposal.

      (iv) The financial implications of adoption of MACP Scheme have been taken into account by the Organisation/Body and the additional financial implications can be met by it within the existing Budget Grants.

2.       As per the revised arrangement, the proposal shall be processed by the Financial Advisor concerned in the first instance and subject to it meeting the requirements spelt out at (i). (ii) and (iv) above, he would obtain the orders of the administrative Head/Secretary concerned for approving the extension of MACPS to such a body.

3.       Above is brought to the notice of all concerned Ministry/Department in continuation of para 14 of Annexure-1 of MACPS dated 19.05.2009.

Grant of financial upgradation under the Modified ACP Scheme – reckoning of Non-Functional Grade (NFG) to DR Assistants/DR Grade ‘C’ Stenographers

Sub: Grant of financial upgradation under the Modified ACP Scheme – reckoning of Non-Functional Grade (NFG) to DR Assistants/DR Grade ‘C’ Stenographers – clarification reg.

In supersession of Board’s Order of even number dated 17.2.2010, it is clarified that DR Assistants/DR Grade ‘C’ Stenographers who have got Non-Functional Grade (NFG) in the Grade Pay of RS.5400 would only be entitled to 3rd financial upgradation in the immediate grade pay of RS.6600 on completion of 30 years of continuous service or on completion of 10 years of stagnation in 2 single Grade Pay, whichever is earlier. No further financial upgradation would be admissible to such officials.

2. This issues with the concurrence of the Finance Directorate of the Ministry of Railways and has the sanction of the President.

Sub:      Revised pay structure of the common category posts of Pharmacists cadre – clarification reg.


      Attention is invited to Railway Board’s letter of even number dated 30.O3.2010 on the above subject.

2.      As per para 2 of Board’s letter dated 30.03.2010 Pharmacist Grade-II and Grade I will be merged and designated as Pharmacist (non- functional grade) in PB 2 with grade pay of Rs.4200/- and the grade will be granted to Pharmacist (entry grade) on non-functional basis after 2 years of regular service in the grade pay of Rs.2800. In view of this, the word ‘promotion’ appearing in para 3 of the letter may be read as ‘placement’. Such placement will, however, be subject to vigilance clearance.

3.      This issues in consultation with Establishment and Health Directorates and concurrence of the Finance Directorate of the Ministry of Railways.

Clarifications regarding pay fixation of existing Group ‘D’ Employees in the revised pay structure

Subject: Clarifications regarding pay fixation of existing Group ‘D’ Employees in the revised pay structure.

Reference is invited to this Department’s Office Memorandum No. 1/1/2008-IC dated 24th December, 2008 wherein clarifications were provided regarding various aspects of placement of the existing Group ‘D’ employees in the revised pay structure.

2. As per the clarification at Sl. No. 1, those Group ‘D’ employees who did not possess the minimum qualification and who have retired/ died in harness between 1.1.2006 and date of notification of Revised Pay Rules will be granted pay band -1S and the grade pay corresponding to their pre-revised pay scale as notified in CCS (RP) Rules, 2008.

3. The aforesaid issue was raised in the 46th Ordinary Meeting of the National Council (JCM) held on 15th May, 2010 and the Staff Side had requested that the cases relating to the non-matriculate class IV employees who retired or died between January 2006 and August 2008 without any re-training be re-considered and such employees should be granted the benefit by re-fixing their pension/ family pension at par with those employees who were retrained and whose pay was fixed in PB-1 with a grade pay of Rs.1800/-.

4. The request of Staff Side on the subject has been considered and it has been decided that the Group ‘D’ non-matriculate employees who died in harness or have retired between 1.1.2006 and the date of notification of CCS (Revised Pay) Rules, 2008 from those Ministries/Departments which have since re-trained all the eligible serving non-matriculate Group ‘D’ employees and have placed them in PB-1 with grade pay of Rs.1800, would be placed in with grade pay of Rs.1800 with effect from the same date that the retrained eligible employees were placed in this pay band and grade pay.

Subject: Clarifications regarding pay fixation of existing Group ‘D’ Employees in the revised pay structure.

Consequent upon the acceptance of the recommendations of the Sixth Central pay Commission by the Government, related to Group 'D' cadres in Central Government, all existing Group 'D' employees are requested to be upgraded to the pre-revised Group 'C' scale of Rs.2750-4400 corresponding to the grade pay of Rs.1900 (Rs.5200-20200) in the manner prescribed in the CCS (Revised Pay) Rules, 2008 (attention is drawn towards Note 1 below Rule 7 of CCS (Revised Pay) Rules, 2008, which prescribes the procedure for fixation of pay of Group 'D' employees in the revised pay structure). Further, in future, posts will be created only in PB-1 and there shall be no recruitment in -1S pay band save in exceptional circumstances as indicated in para 2.2.10 of the Report of the Sixth Central Pay Commission.

Following the notifications of the CCS (Revised Pay) Rules, 2008, this Department has received references from some administrative departments, seeking clarifications regarding various aspects of placement of existing Group 'D' employees in the revised pay structure. The matter has been considered in this Department. The points of doubt raised by administrative departments and the clarifications thereto are issued as under:



1. How will the pay of those Group 'D' officials who do not posses the minimum qualification and have retired/died in harness from 1.1.2006 till date be fixed in the revised structure? Whether they will be placed in -1S pay band or in the pay band PB-1? Those Group 'D' employees who did not possess the minimum qualification and who have retired/died in harness between 1.1.2006 and date of notification of Revised Pay Rules will be granted pay band -1S and the grade pay corresponding to their pre-revised pay scale as notified in CCS (RP) Rules, 2008.
2. What will be the training curriculum, period and the procedure for placement of those Group 'D' officials in PB-1 band who do not possess the minimum prescribed qualification ? Each administrative department concerned will design a training curriculum suited to its requirements. As far as possible, the training programme should not exceed 3 months and it may be imparted during working days for not more than 2 hours per day. The Department concerned will bear the expenditure for training.
3. In the case of those Group 'D' officials who were in the pre-revised scale of Rs.2550-55-2660-60-3200 (e.g. Peon) and who are to be placed in the pay band PB-1 with Grade Pay of Rs.1800 w.e.f. 1.1.2006 and are subsequently granted ACP/Promotion, it is not clear as to what will be their grade pay. If the grade pay remains unchanged, the officials will not be getting any benefit on promotion/ACP. In case they are granted next higher grade in the hierarchy of revised pay structures, it will put seniors viz Daftry/Senior Peons etc at a disadvantageous position. Government servants who have been granted financial upgradation to a higher scale under the ACP Scheme will be granted the grade pay corresponding to the higher pre-revised pay scale that was granted to them under ACP. However, in case of erstwhile Group 'D' employees, all such eligible employees will be granted grade pay of Rs.1800 in PB-1, irrespective of their pre-revised Group 'D' pay scale whether granted the them on regular appointment/promotion or under ACP.

               The undersigned is directed to say that in relaxation of CCS (LTC) Rules,1988, the Government have decided to permit Government servants to travel by air to North Eastern Region on LTC as follows:-

(i) Group A and Group B Central Government employees will be entitled to travel by Air from their place of posting or nearest airport to a city in the NER or nearest airport ..

(ii) Other categories of employees will be entitled to travel by air to a city in the NER from Guwahati or Kolkata.

(iii) All Central Government employees will be allowed conversion of one block of Home Town LTC into LTC for destinations in NER.



  

              2. These orders shall be in operation for a period of two years from the date ofissue of this O.M.

  

              3. Data regarding number of Government employees availing LTC to NER may be maintained.

  

              4. In their application to the staff serving in the Indian Audit and AccountsDepartment, these orders issue after consultation with the Comptroller and AuditorGeneral of India.

               In supersession of this Department's O.M. of even number dated 12th January, 2010, the undersigned is directed to say that it has been further clarified by Establishment (D) Assistants/DR Grade 'C' Stenographers who have got Non-functional grade (NFG) in the grade pay of Rs.5400/- would only be entitled for 3rd financial upgradation in the immediate higher grade pay of Rs.6600/- on completion of 30 years of continuous service or on completion of 10 years stagnation in a single grade pay, whichever is earlier.. No further financial upgradation would be admissible to such officials.

Sub: Benefit of reservation to persons with disability who acquire disability after entering into Govt. service..



The undersigned is directed to say that various Ministries/Departments have been seeking clarification whether a person who acquires disability after entering into Government service shall get the benefit of reservation in services as provided in this Department's OM No.36035/3/2004-Estt.(Res.) dated 29.12.2005.

2. It is hereby clarified that the OM dated 29.12.2005 does not make any distinction between persons acquiring disability before or after entering into service. An employee who acquires disability after entering into service will be entitled to get the benefit of reservation as a person with disability as provided in the instructions contained in the above referred OM from the date he produces a valid certificate of disability.

3. All Ministries/Departments etc. are requested to bring it to the notice of all establishments under their control.

The matter has accordingly been reexamined and it has been decided to revise the last pay range slab i.e. Rs.9701-23730 appearing at S.No. 3 of the table contained in Railway Board's letter dated 1.12.08(RBE No. 190/08), as Rs.9701-26170. Subject: Date of next increment in cases where Government servants are not able join posts in a particular grade pay on promotion/appointment on 1st of January of a year due to Sunday or Gazetted Holiday – Clarification regarding.

As per the provisions of Rule 10 of CCS (RP) Rules, 2008, w.e.f. 1.1.2006, in the case of all Central Government employees there is a uniform date of increment, i.e. 1st July of every year.

Government servants completing six months and above in the revised pay structure as on 1st of July are eligible to be granted the increment. From the above provision of CCS (RP) Rules it flows that Government servants who have rendered less than 6 months of service as on 1st of July of a year will not be eligible to draw increment on that day and their date of increment will fall 12 months later on the next 1st of July.

Accordingly, all the Government servants who join posts in a particular grade on account of promotion / appointment etc., on 1st of January of a year will be eligible to draw their annual increment on the 1st of July of that year. However, those who join the posts between 2nd January and 30th June, will not be eligible for the same.
In the light of the above position, some administrative departments have sought clarification from this Department regarding date of next increment in cases where Government servants are not able join posts in a particular grade pay on promotion / appointment on 1st of January of a year due to 1st of January falling on a Sunday or Gazetted holiday.

In this connection, it is clarified that in the normal course, if a Government servant was to join post in a grade pay on appointment / promotion on 1st of January of the year happened to be a Sunday or Gazetted holiday, the Government servants who join posts on the 1st working day of the year will be treated to have completed 6 months of service on 1st of July of that year for the purpose of granting them annual increment on that day.

Government Of India Notification About IME India Recognition



Mechanical Engineers (India), Mumbai Course, equivalent to Degree in Mechanical Engineering

NOTIFICATION

No.F.23 – 2 / 2001 – TS.III. The Institute of Mechanical Engineers (India), Mumbai has been running Section A & B of Association Membership Course, equivalent to Degree in Mechanical Engineering since 1976, vide this Ministry’s letter No.F.18 – 31 / 71 – T.2 dated 28.05.1976 and part I & II of Technician Polytechnic, since 1988, vide this Ministry’s letter No.F.1 - 5 / 87 / T.7 / T.13 dated 11.07.1988.In the year 2002, while withdrawing the recognition of these courses, Government of India allowed the IME (India), Mumbai to approach this Ministry for recognition of their Diploma / Degree courses only after the removal of all the deficiencies pointed out by AICTE.

Accordingly, the above Institute submitted a request along with the requisite material for review and consideration of this Department. This Department got the material re-examined by AICTE. AICTE, through its Expert Committee re-examined both the courses and submitted its recommendations with revision of syllabus for both the courses. The High Level Committee for recognition of educational qualification considered the matter in its meeting held on 16.10.2006 and on its recommendations, Government of India has decided the following:

(i) The recognition of the courses run by IME, Mumbai may be restored with effect from 16.10.2006. With this recognition IME will run the courses based on new syllabus approved by All India Council for Technical Education (AICTE). As per the approval, the Technician Engineers courses part I & II papers at present. In addition to this, there will be nine elective subjects. After completing theory papers, students will have to undergo at least 3 months mandatory apprenticeship / practical training / project report at an All India Council for Technical Education approved polytechnic for part I & II of Technician Engineers Courses for award of Certificate equivalent to Diploma in Mechanical Engineering and the Apprenticeship / Practical training of the same duration in AICTE approved Degree Colleges for award of Certificate equivalent to Bachelors Degree in Mechanical Engineering for Section A & B Associate Membership Courses.

(ii) The students who were registered prior to 10.06.2006 for part I & II of Technician Engineers (Diploma Level) and section A & B of Associate Membership Courses (Degree Level) will be allowed to complete the courses with pre-revised syllabus till the next scheduled examination, to be held in December 2006. Their Degree / Diploma will be recognized for employment in Central Government. Those who do not complete their courses by that time (December 2006), will have to follow the revised syllabus.
