SUBJECT:     Revision of guidelines for framing / amendment / relaxation of Recruitment Rules.

      The undersigned is directed to state that instructions on framing / amendment of Recruitment Rules were issued in a consolidated form in this Department's OM No. AB. 14017/12/87-Estt.(RR) dated 18.3.1988. Subsequently, a number of orders and clarifications have been issued on the subject.

2. The existing instructions have been reviewed in consultation with WSC and consolidated in the form of "Guidelines on framing / amendment / relaxation of recruitment rules", a copy of which is enclosed. The number and the date of original OM has been referred in the relevant instructions for easy reference to the context. The Guidelines on framing / amendment / relaxation of recruitment rules along with the relevant instructions and existing model RRs are available on the DoPT websitewww.persmin.nic.in* in the dynamic form of Handbook on Recruitment Rules, 2010. This Department would continue to update these instructions from time to time.

Subject :        Probation in various Central Civil Services.

       The undersigned is directed to say that the period of probation to be prescribed for different postslservices in Central Government have been laid down in this Department’s O.M. No. F.44/1/59-Ests.(A) dated 15.4.1959 as amended from time to time. Although instructions exist to the effect that save for exceptional reasons probation should not be extended for more than a year and no employee should be kept on probation for more than double the normal period apart from instructions for timely action on completion of probation/confirmation, these are not invariably followed.

2. With a view to prevent Government servants from becoming possible victims of arbitrary actions or inordinate delay in considering completion of probationlconfirmation, the existing instructions on provisions regarding probation in the servicelrecruitment rules relating to Central Civil Services and Posts have been reviewed. It has now been decided that :-

(I)         If during the period of probation, a probationer has not undergone the requisite training course or passed the requisite departmental examinations if anybrescribed or has not been on dutyitraining for at least 75% of the probation period, the period of probation may be extended by such period or periods as may be necessary subject to the condition that the total period of probation does not exceed double the prescribed period of probation except in the cases mentioned in (ii) below:-

II)        the period of probation may be extended for such period as the Central Government may think fit in the circumstances of the case in respect of a probationer who is:

a)        under suspension;

b)        against whom disciplinary proceedings are pending; or

c)        against whom prosecution for criminal charge is pending.

III)        Where a probationer who has completed the period of probation to the satisfaction of the Central Government is required to be confirmed, he shall be confirmed in the SewicelPost at the end of his period of probation, having been completed satisfactorily. In such cases, where no order extending the probation period has been issued and no order of confirmation is issued within one year of completion of the prescribed period of probation, the probationer would be deemed to be confirmed in the servicelpost.

3.        In the Service/Recruitment Rules for all Central Civil Services and Posts, in addition to the period of probation, wherever prescribed. corresponding provisions, as in para 2 above, may be incorporated in consultation with this Department in the light of the above instructions.

Recruitment of staff from open market in Pay Band-1 of Rs.5200-20200 having Grade Pay of Rs.1800/-

     Sub: Recruitment of staff from open market in Pay Band-1 of Rs.5200-20200 having Grade Pay of Rs.1800/-.

     Attention is invited to instructions contained in para 3(vi) of Board’s letter No. PCVI/2008/I/3/1, dated 29.10.2008 (RBE No.160/2008), interalia stating that the instructions regarding minimum educational qualification for fresh recruitment to Railway services in PB-1 Grade Pay Rs.1800 (erstwhile Group ‘D’ posts) would be issued separately by the Establishment Directorate.

2.    The Ministry of Railways have decided that henceforth minimum educational qualification for recruitment in Pay Band-1 of Rs. 5,200-20,200 having Grade Pay of Rs. 1800/- will be 10th pass or ITI or equivalent. These instructions will be applicable for all future recruitment henceforth against direct recruitment quota through all modes.

3.    As regards the ongoing recruitment exercises presently under way on Central Railway, Eastern Railway, East Coast Railway, East Central Railway, Northeast Frontier Railway, North Eastern Railway, North Central Railway, Southern Railway, South Western Railway and West Central Railway, the same will adhere to the prescribed minimum qualification of 8th pass as laid down vide letter No. E (NG)II/98/RR-1/107 dated 4.12.1998 (RBE No. 277/98).

4.    All Railways are directed to initiate the recruitment process immediately to fill up current vacancies including anticipated vacancies for the next two years as well as resultant vacancies owing to promotion of staff to higher grades etc., excluding the vacancies worked out on the basis of prescribed percentage against ex-servicemen quota for which separate recruitment is in progress, with the revised minimum qualification of 10th pass or ITI or equivalent. Railways may also ensure filling up of Physically Handicapped quota including backlog vacancies in this recruitment exercise.

5.    The Railways mentioned in Para 3 above should also initiate recruitment to fill up the vacancies accrued beyond the vacancies already notified for which recruitment is in progress.

6.    All Railways should initiate the process by way of issue of notification in the national and local dailies, etc. by 15th December, 2010, positively. Candidates may be given two months time to submit their applications and candidates from Andaman & Nicobar, Lakshadweep Islands etc. will be given 15 days extra as per extant rules in response to the above notification.

7.    It has further been decided that written examination will be held on the same day simultaneously by all the railways. Similarly Physically Efficiency Test (PET) will also be held during the same period simultaneously by all the Railways. These instructions should be prominently mentioned in the notification.

8.    The format of application should be limited to a single page only A draft format of application form is enclosed herewith for necessary action which may be modified suitably depending on the local requirements.

9.    Instructions contained in letter No. E (NG)II/96/RR-1/62/Vol.II dated 08.12.2010 regarding waiver of fee for women, minority communities and economically weaker sections will apply.

10.    All General Managers are to ensure that Railway Recruitment Cells (RRCs) are strengthened sufficiently by providing accommodation, equipment, vehicles, security, manpower, etc., so that the recruitment process is completed smoothly without any problem.

Model Recruitment Rules for Group ’C' Post

Subject: Model Recruitment Rules for Group 'C' posts in Pay Band-I, with Grade Pay of Rs.1800/- (pre-revised Group 'D' posts)

               The 6th CPC recommended that all Group ‘D’ posts in the Government will stand upgraded to Group ‘C’, Pay Band-I with Grade Pay of Rs.1800, along with the incumbents (after suitable training, wherever required). The other recommendations of the Commission, in this regard include:

  

(i) There will be no further recruitment in Group ‘D’.

  

(ii) The existing Group ‘D’ posts will be placed in Group’C’ Pay Band-I with Grade Pay of Rs.1800.

  

(iii) The minimum qualification for appointment to this level will be either l0th pass or IT1 equivalent

  

(iv) Multi- skilling, with one employee performing jobs hitherto performed by different Group ‘D’employees.

  

(v) Common Designation for these posts,

  

2. Model Recruitment Rules (Annex-I) have been framed keeping in view the recommendations of the Pay Commission. All the Ministries/Departments are requested to amend the Recruitment Rules for the erstwhile Group’ D’ posts as per the Model RRs and the recommendations of the Pay Commission.

  

3. Powers for framing1 amendment of RRs for Group 'C' posts have already been delegated to Ministries / Departments. Therefore the RRs may be framed accordingly, in consultation with Ministry of Law without further reference to this Department. This Department needs to be consulted only if any deviations from the model RRs are proposed.

  

4. Ministries Departments may adopt the designation of MULTI- TASKING STAFF for some common categories of posts in the secretariat offices. Annex-II indicates the categories of erstwhile Group 'D' posts which may be given this designation and illustrative list of duties attached to these posts. For other categories of posts, Ministries Departments may adopt single designation for posts whose duties are similar in nature and where the officials can easily be switched from one task to another. In all cases it may be ensured that:

  

a) The posts are classified as Group 'C'

  

b) The posts are placed in Pay Band-I with Grade Pay

  

of Rs.1800. c) The minimum qualification for appointment is prescribed as 10th pass. Where technical qualifications are considered necessary, IT1 in the relevant subject may be prescribed as the minimum qualification.

  

5. Ministry of Home affairs etc. are requested to bring the contents of this 0.M to the notice of all their Attached1 Subordinate Offices. The autonomous1 statutory bodies may adopt the same with the approval of the competent authority as per their rules1 statutes.
