Transfer policy of KV teachers revised

New Delhi, Nov 3 (PTI) Revising the transfer guidelines of Kendriya Vidyalaya (KV) teachers, the Government today approved certain amendments like giving fair chance to every employee to get a choice posting and placement in "hard stations" both for men and women teachers.

At the same time, it also cleared the way for KVs to conduct skill development courses in campuses everyday by making optimum utilisation of the infrastructure and introducing foreign language programme starting with German.

The decisions was taken at the 89th meeting of the board of governors of KV sangathan chaired by HRD Minister Kapil Sibal.

Sources said the guiding principles of the transfer policy would give every teacher a "fair chance of getting a choice posting but in a transparent manner".

Subject:   Time limit for framing of Rules and Regulations on conversion of Government Department into PSUs/autonomous/statutory body



            The undersigned is directed to refer to the above subject and to state that the instructions on matters relating to regulation of service conditions of Government employees on transfer to autonomous organizations have been issued by the Department of Pension and Pensioners' Welfare. The provisions included in the relevant portion of Rule 37 (A) of the Central Civil Service (Pension) Rules, 1972 refers.

2. This Department has examined issues pertaining to service conditions,promotion / confirmation, etc. in respect of the deemed deputationists on a reference received from the administrative Ministries. It has been decided that in such cases where there is a conversion of a Government Department into PSUs/autonomous/statutory body, there must be a time frame within which a new body shall frame its rules and regulations. At the end of this period, all employees on deemed deputation should have opted either to get permanently absorbed in the new organization or revert to the Government. A maximum period of 5 years for framing of rules and another 2 years for phasing out repatriation to those opting to come back to has been prescribed. All the Ministries/Departments are accordingly advised to adhere to the time frame whenever a proposal for transfer of employees is considered as above.

Sub: Travelling Allowance Rules - Implementation of the Sixth CPC.

The undersigned is directed to refer to this Department's OM of even number dated 23.09.08 on the subject cited above and to say that it has been brought to Government's notice that the issue of this OM has led to lowering of the per km rates for transportation of personal effects by road on transfer in the case of A-1 / A / B-1 class cities. The provision under para 4.C of the said OM has been reviewed and it has now been decided to replace the existing provisions contained in para of the said OM dated 23.09.08, with the following:

2. Attention is also invited to para 4.B of the OM dt. 23.09.08, which regulates the payment of Composite Transfer Grant. In this connection, it is reiterated that the

components and incidentals which were merged/subsumed with the Composite Transfer Grant, as per para 4.B of this Ministry's OM No.19003/2/97-E.IV dt. 17.04.98, remain unchanged.

3. The revised provisions as under para 1 above, shall be applicable w.e.f. 01.09.2008, i.e. the date from which revised T.A. rules are applicable.

Fixation of pay in case of employees who seek transfer to a lower post under FR 15(a)

Subject:- Fixation of pay in case of employees who seek transfer to a lower post under FR 15(a) - clarification regarding.



The undersigned is directed to refer to instructions issued vide this Department's OM NO. 16/6/2001-Estt(Pay-I) dated 14.2.2006 on the above subject. It was clarified therein that on transfer to the lower post/scale under FR 15(a), the pay of a Government servant holding a post on regular basis will be fixed at a stage equal to the pay drawn by him in the higher grade. If no such stage is available, the pay will be fixed at the stage next below the pay drawn by him in the higher post and the difference may be granted as personal pay to be absorbed in future increments. If the maximum of the pay scale of the lower post is less than the pay drawn by him in the higher post,his pay may be restricted to the maximum under FR 22(a)(a)3).

2.Consequent upon implementation of the revised pay structure comprising grade pays and running Pay Bands, w.e.f. 1.1.2006 in cases of appointment of Government servants to posts carrying lower Grade Pay under FR 15(a) on their own request, the pay in the pay band of the Government servant will be fixed at a stage equal to the pay in the pay band drawn by him prior to his appointment against the lower post. However, he will be granted grade pay of lower post. Further, in all cases, hewill continue to draw his increments based on his pay in the pay band +grade p(lower).

3. Where transfer to a lower post is made subject to certain terms and conditions then the pay may be fixed according to such terms and conditions.

4. In so far as persons serving in the Indian Audit & Accounts Department are concerned, these orders issue after consultation with the Comptroller & Auditor General of India.

5. This order takes effect from 1.1.2006.
